Cyclists, bicycle commuters and pedestrians who are struck by cars are often made to feel it was their fault, regardless of the chain of events that took place. Our number one objective is to clearly dispel any belief that cyclists and pedestrians are guilty simply because they found themselves in a dangerous situation by choosing to walk or ride their bike. Cyclists and pedestrians have the same rights as cars, regardless of the details of the case.

Following is some valuable information and statistics:

Bicycle accident causes:
The majority of serious bicycle accidents resulting in catastrophic injuries and deaths are the results of a collision with an inattentive driver. In most cases, the driver’s fault consists of failing to yield to the cyclist, backing out of a driveway, opening the door as a cyclist rides by, running a stop sign, simple inattentiveness or unfortunately driving under the influence of drugs or alcohol.

Do to the increase in bike traffic throughout the United States and particularly in Austin, there are more special bike laws available to cyclists. In spite of this, however, many motor vehicle drivers do not respect the cyclist’s rights to share the roads and more importantly, many cyclists have not been properly educated on how to legally and safely share the roads with automobiles.

Negligent automobile drivers and uneducated bicyclists have resulted in staggering statistics.
Every six hours a cyclist is fatally injured.
Approximately 1 million children are injured each year in bicycle-related accidents.
Nearly half of all bicycle fatalities occur to children under the age of 16.
Head injuries account for about 75% of all serious injuries and fatalities from bicycle accidents.

Under the Texas law, bicycle riders are also subject to the same traffic law as motorist. If you are riding a bicycle, you are also required to obey the traffic laws and you deserve the same protection by those laws as automobile drivers. If you or a loved one have been injured in a bicycle accident, it is imperative that you immediately contact an aggressive and successful personal injury firm, such as The Bratton Firm.
